References to "we", "us" or "our" in these terms mean Stelimasa Energy Limited. References to "you" or "your" mean the customer or prospective customer engaging our services.
Stelimasa Energy provides energy and environmental intelligence services for UK buildings. Our services include:
Important — mould risk monitoring: Our damp and mould risk monitoring service measures environmental conditions that are associated with mould risk (primarily relative humidity and temperature). We do not detect, certify, identify or confirm the presence or absence of mould. Our monthly reports flag when conditions persistently exceed risk thresholds. We are not a surveyor or mould remediation service. Where mould is suspected or confirmed, you should engage a qualified surveyor or remediation specialist.
We coordinate the deployment of monitoring sensors through approved technical installation partners. We own the customer relationship and provide monthly insight reports. We are not an installation contractor, sensor manufacturer, carbon credit generator or compliance certification body.
A contract between you and Stelimasa Energy is formed when you sign our client engagement agreement and pay the agreed setup fee. Our proposal or quotation constitutes an offer. Your signed agreement and payment constitute acceptance.
Where you engage us for a 90-day pilot, the contract covers: site consultation, partner-led sensor installation, three monthly insight reports and an end-of-pilot review. At the end of the pilot period, we will offer you options for ongoing monthly subscription. You are under no obligation to continue beyond the pilot unless you have separately agreed to a subscription term.
Where you agree to an ongoing monthly subscription following a pilot or as a standalone engagement, your subscription will continue on a rolling monthly basis unless either party gives 30 days' written notice of termination. Minimum subscription terms, where agreed, will be stated in your client engagement agreement.
You are responsible for:
Physical sensor installation, configuration and device maintenance is carried out by approved technical installation partners, not by Stelimasa Energy directly. Our technical partners are engaged under separate Partner Fulfilment Agreements which set out installation standards, data handling obligations and liability.
We are responsible for:
Where an installation issue is caused by a technical partner's error or negligence, we will coordinate the remedy. Our total liability in respect of installation-related failures is set out in section 5.
Electrical work: Where CT101 current transformers are installed inside consumer units or distribution boards, this work must be carried out by a qualified electrician. We ensure our approved partners hold appropriate qualifications. You must not interfere with installed sensors or associated wiring.
We take reasonable care to ensure that our monitoring services are delivered accurately and that our monthly insight reports are prepared with reasonable skill and care based on the data collected from your site sensors.
We are not liable for:
Our total liability to you in connection with any contract under these terms, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the total fees paid by you to Stelimasa Energy in the 12 months preceding the event giving rise to the claim.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
You may cancel your subscription at any time by giving 30 days' written notice to hello@stelimasaenergy.com. Where you have agreed a minimum subscription term, early cancellation charges may apply as set out in your client engagement agreement. Setup fees are non-refundable.
We may terminate your contract with immediate effect if you fail to pay sums due, breach these terms in a material way, or if we reasonably believe continued service would require us to act unlawfully. We will give you written notice of termination.
Where sensors are owned by Stelimasa Energy or our technical partners, we will arrange collection within a reasonable period following termination. You must provide reasonable access for collection. Where sensors are sold to you as part of your setup package, they remain your property on termination.
All monthly insight reports, methodology, algorithms, report templates, dashboard designs and data processing approaches developed by Stelimasa Energy remain the intellectual property of Stelimasa Energy Limited.
You are granted a licence to use your monthly reports for your own internal purposes, including sharing with your board, funders, tenants or regulators. You may not resell, reproduce or present our reports as your own work product.
Raw sensor data collected at your site remains associated with your account. You may request an export of your site data at any time. On termination, we will provide a data export in a standard format within 30 days of your written request.
